If I am considered a trader insecurities will the wash sale still apply to me?
 
Answer:

We speak to a number of clients who mistakenly believe that the wash sale rule does not apply to “trader in securities” or “trader status”. Contrary to this common fallacy, the wash sale rule still applies to a trader in securities. A mark-to-market election must be in effect to avoid the wash sales. This confusion could be caused by the fact that the mark-to-market accounting election is only available to “trader in securities”.
